Family Courts Act, Provisions, Jurisdiction, and Amendment of 2022

The family is the fundamental social institution present in every society, it forms the basic unit of modern society. It is a globally recognized group forming an emotional connection among its members. Family can be defined as a group of people who are tied by social institutions like marriage or bound by blood. We will discuss the role of Family Courts, their provisions, and their jurisdiction in this article, along with recent amendments of 2022.

A family can be categorized into four types which are listed as follows:

  • Nuclear Family: A family group including a couple and their unmarried children living in one household dwelling. 

  • Joint Family: A combination of two or more nuclear families sharing one household dwelling is known as a joint family.

  • Matriarchal Family: A family where power and property are passed through the female line, which means the rulers of the family are female members. After marriage, a couple resides in the bride’s home rather than the bridegroom's.

  • Patriarchal Family: A family group where the source of authority as well as succession is passed through the male bloodline. After marriage, the sons live in their parent’s home whereas the daughters have to leave to reside at their spouse's home.

In such families, there are various disputes either between the married couple, property-related issues, adoption, or guardianship of the child. In order to handle such issues, Family Courts are developed with the primary motive of resolving the legal issues between the families via reconciliation wherever possible.

  Introduction The  Equal Remuneration Act, 1976  is an important legislation in India that prohibits discrimination in terms of remuneration on the grounds of gender. It means the Act ensures equal pay for men and women for the same or similar work.
