Bilkis Bano Case: Supreme Court to hear petitions against remission of 11 convicts on August 7

  The Supreme Court fixed the hearing of petitions filed by  Bilkis Bano  and others related to the  2002 Gujarat riots  on August 7, 2023. The petitions were against the remission granted to all 11 convicts for the crime of gang-raping Bilkis Bano and killing her family members. The matter will be heard by the bench headed by  Justice BV Nagarathna . While hearing the matter today, Justice Nagarathna and  Justice Ujjal Bhuyan  pronounced, “The counsel for Bilkis Bano submitted that newspaper publication as directed by this court was effected on June 1, 2023, and an affidavit with that regard was filed on June 7. Similarly, in other cases, notices on the respondent are stated to be served either directly or by newspaper publication. This fact is not disputed by Solicitor-general for India  Tushar Mehta  appearing for both the Union of India and the  State of Gujarat , as well as other counsel appearing for the private respondents.   Fresh Guidelines issued by the Supreme Court for the designation of Senior Advocates In association with the latest judgment in the  Indira Jaising vs Supreme Court  case, the top Court issued fresh guidelines for the designation of senior advocates. The  Supreme Court  directed Advocates/ Advocates-on-Record to update their previous applications by furnishing information/data in the newly prescribed format. It also directed the Advocates to substitute their applications with fresh applications in a prescribed format. Moreover, the Supreme Court also directed the Advocates-on-record/ Advocates to withdraw applications by August 7, 2023, without affecting their entitlement to apply for designation to any of the Supreme Court or High Court. Apart from this, fresh applications were also invited by the top Court from Chief Justices as well as judges of High Courts who are interested in being addressed as Senior Advocates. Caveat against Congress leader Rahul Gandhi filed in Supreme Court

A caveat is filed in the  Supreme Court  by the complainant,  Purnesh Modi , in anticipation of an appeal against the judgment of the  Gujarat High Court  refusing to stay  Congress  leader  Rahul Gandhi ’s conviction in a defamation case. The caveat is a legal notice filed by a party informing that the opposite party may file a case against them. On July 7, the day when Gujarat HC gave a decision in the defamation case where Rahul Gandhi made a remark on the ‘Modi’ surname, a caveat was filed by the complainant. Earlier in March 2023, Rahul Gandhi was found guilty of defamation remarks made by him during 2019 election campaigns.   Abrogation of Article 370: Supreme Court to hear the petitions from August 2, 2023 Today, Chief Justice of India  DY Chandrachud  fixed August 2, 2023, as the starting date for hearing a batch of petitions against the abrogation of Article 370 of the  Indian Constitution . CJI said that the petitions will be heard every day from 2nd August except Mondays and Fridays. Earlier on 3rd July 2023, a notice was issued by the Supreme Court stating that the five-judge Constitution bench for hearing matters related to dilution of Article 370 constitutes, CJI Chandrachud, Justice  Sanjay Kishan Kaul , Justice  Surya Kant , Justice  BR Gavai , and Justice  Sanjiv Khanna .   Collegium recommends the name for the elevation of Chief Justices Ujjal Bhuyan and SV Bhatti as Supreme Court judges On July 5, 2023, the  Supreme Court  Collegium recommended the elevation of two Chief Justices of two High Courts as judges of the Supreme Court. The recommended names are Chief Justice of Telangana High Court Ujjal Bhuyan and Chief Justice of  Kerala High Court S. Venkatanarayana Bhatti . The Collegium members made recommendations, constituting Chief Justice of India  DY Chandrachud , Justice Sanjay Kishan Kaul, Justice BR Gavai, Justice Sanjiv Khanna, and Justice Surya Kant. In a resolution published on July 5, the Collegium noted “The Supreme Court of India has a sanctioned strength of thirty-four Judges and is presently functioning with thirty-one Judges. Thus, there are three clear vacancies. That makes it imperative for the Collegium to take steps to fill up the vacancies with a view to augment the working judges’ strength to take care of the backlog of cases and
